Taking an utilitarian approach the economical viability of a patent system would be determined by how well it would harmonize the cost of the inventor and the cost of imitators in that it would foster invention and not hinder it. Patents would only be necessary in a situation where the cost of the imitator is significantly lower than that of the inventor. In a situation where an imitators cost is significantly higher than that of the inventor, the patent would be too broad as it would hinder invention.
